Agreement on the Terms and Conditions of the Use of Images

This Agreement (hereinafter the "Agreement") governs the terms and conditions under which the Administration of the Tilda Publishing Platform (https://tilda.cc) (hereinafter the "Administration", the "Platform Administration") provides access to the Image Library (hereinafter the "Images") to its customers (hereinafter the "User", the "Platform User"), and is an integral part of the Platform's Terms of Service Agreement (https://tilda.cc/terms).

The Administration hereby grants the Platform User the ability to select and further use the Images available on https://tilda.cc, namely in the User's personal profile in the "Image Library" section, for the purpose of creating their own Website (in this case the Website is understood to be a website created on the Tilda Publishing Platform using the tools provided by the Platform).

1. General Provisions

By using Images from the Image Library, which includes icons, vector images, and/or photographs from selected vendors that can be used for projects on Tilda, the Platform User accepts and agrees to all the provisions of this Agreement without any reservations or conditions (acceptance).

2. Images from Depositphotos (Tilda Images)

Tilda Images is a photobank with a premium collection of 600 000 photos and images. Platform Users can use the materials in the collection in any authorized way, including adding them to commercial projects on Tilda without payment. The User has no obligation to request permission to use the images or an obligation to credit the author. Depositphotos is the exclusive provider of the library. Detailed terms of use for Tilda Images are outlined in the relevant Usage Agreement and License Terms.

3. Google Images

Google Images is a service for searching images on the Internet by Google.

Images on the service may be protected by copyright. Before using the content found on the service, the User should verify that the image’s license is valid and clarify its terms. Information about how to check the license and terms of use of an image can be found at: https://support.google.com/websearch/answer/29508?hl=en&ref_topic=3180360.

Images may be licensed under:

The Creative Commons license, which means that the User can copy, modify, distribute, and use the images for free, including commercial use. Images with this license are usually free, but the User must provide the name of the author and a link to the source. The terms of their use may also be restricted. For example, the license may state that the image cannot be modified or used for commercial purposes.

Commercial and other licenses. These images do not have a Creative Commons license and can be sourced from websites that distribute them for free or from commercial websites (in this case the images can only be used after purchase).

The Administration only provides the User with access to the Google Images search service. The Administration has no property or other rights to the images contained on the service and does not guarantee the absence of claims from the copyright holder.

4. Linea Icons

Linea.io is a collection of icons created by designer Dario Fernando. All images are licensed under the Creative Commons Attribution license, which means that the User can copy, modify, distribute and use the images for free, including commercial use. The terms of use for Linea images can be found at: https://creativecommons.org/licenses/by/4.0.

5. Tilda Icons

Tilda Icons is a collection of free icons from Tilda. Users can use all the icons on the Tilda Platform in their personal and commercial projects. It is possible to download the icon sets in SVG format on the Tilda Icons page. Details about the terms of use can be found at: https://tilda.cc/free-icons/license.

6. Images from Instagram

The User can add their own images from their Instagram account. Users can connect their Instagram account or Facebook page to use photos from their profile on the Platform.

7. User Images

Users may independently upload images to the Website from their device or from the Internet. At the same time, the User guarantees and is responsible for the lawful use of the image uploaded by them, as well as the availability of all necessary authorization documents and/or relevant rights to it. If the image right holder demands that the User stops the unlawful use of the image, the Platform Administration has the right to block the project and/or User's account or to limit the project and/or User's account at its sole discretion.

8. Granting of Rights

The Administration provides the Platform Users with the tools to use the Images. At the same time, any such use must not contradict the terms of the license/permit for the corresponding Image used by the User. The right granted to the Platform User is limited to the "right to use," and nothing in this Agreement shall transfer to the User the exclusive right to the Images. The terms of the right to use the Images are governed by the right holder of the Image or their authorized representatives (designees).

The Platform User acknowledges and agrees that all proprietary and/or personal non-proprietary copyrights in the Images are owned by the Authors of such Images and are not transferred (not relinquished) to the Platform User under the terms of this Agreement. The Platform User undertakes not to perform any actions that violate or may violate the rights of the Authors or right holders to the corresponding Images.

9. Permitted Use

The Platform User is entitled to use the Images in strict compliance with the license/ permit terms applicable to the Images of a particular photobank/collection of images.

10. Prohibited Use

By using the Images, the Platform User agrees to the prohibitions and restrictions on their use as set forth in the license terms for the corresponding Images and in the terms of this Agreement, including, without limitation, the following:

prohibition on transferring, reselling, leasing, or otherwise transferring Images to third parties;
prohibition on using the Images to create an official logo, trade name, trademark, or another intellectual property item;
prohibition to make the Images available for free download on a shared drive, software, website, or any other device and/or resource for exchange, transfer, or distribution;
prohibit the use of the Image in any way not expressly permitted by the license and/or terms of this Agreement.

The use of Images falling within the prohibited scope will be deemed a copyright infringement. The Platform User is responsible for all losses resulting from copyright infringement, including any claims of third parties. The Platform Administration reserves the right to establish a limitation or ban on the use of Images if they are used in violation of copyrights and/or the terms of this Agreement.

11. Warranties and Responsibilities

The Platform User declares and warrants that they will strictly adhere to all license terms and conditions of use of the Images under the terms of the corresponding licenses and this Agreement and that he/she will be solely responsible for the use of the Images in violation of the specified rules.

The Images are provided "as is" without warranties of any kind. The User assumes all risks associated with the quality of the Images and their use.

The Platform Administration does not guarantee the permanent accessibility of the Images and is not responsible for their removal by the right holder or their authorized representatives. The right holder or their designees manage the photobank/collection of images at their own discretion and as such may add or remove any Images at any time.

The Platform Administration shall not be liable for any costs, damages, or losses incurred by the User of the Platform as a result of such actions of the Rights Holder or its authorized persons and in general as a result of the use of the Images by the User.
