Content Generation Feature

Terms of Use

In order to provide the function of generating content on Tilda based on artificial intelligence technologies this general terms of use for the function have been created. The terms define the goals and limits of acceptable usage, as well as limit Tilda’s liability with respect to the content generated by artificial intelligence.

The Content Generation Feature Terms of Use (hereinafter referred to as the Terms) are an integral part of the Terms of Service (hereinafter referred to as the Agreement). All terms and definitions are used in the Terms in the same meaning as in the Agreement in force.

Among others, all restrictions and limitations specified in the Agreement apply to the Users' actions and the Content placed on the Platform.
1. Terms of Use
1.1. General Provisions. The content generation function based on artificial intelligence technologies (hereinafter referred to as the Feature) provides the possibility to create software code, texts, icons, emojis and/or images on the Platform by using a range of generative models (hereinafter referred to as the Generated content) on the basis of a corresponding request from the User (hereinafter referred to as the Request).

The Feature is available on the Platform in:
1) the AI Assistant which provides the User with the opportunity to create texts and images on a Project;
2) the "Vibe Block" feature, which enables the creation of software code on a Project, as well as related texts, icons and/or emojis.

1.2. Third‑Party Services. The Function provides the ability to use artificial intelligence-based models, provided by third‑party providers (hereinafter referred to as the Third-party services). The use of a particular Third-Party service is based on the language of the Request as well as the method chosen by the User to create the Generated сontent.

The use of a particular Third Party Service is based on the selected functionality, the language of the User’s Request and/or the method of creating the Generated content selected by the User.

By using the AI Assistant, the User agrees to the Google Terms of Service, the OpenAI Sharing and Publication Policy and the Yandex Foundation Models Terms of Use. When using the "Vibe Block" feature, the User also agrees to the agreements of the owners of the Third‑Party Services selected in the functionality.

1.3. Cost of Using the Feature. The ability to create text content in the AI Assistant is provided to all Platform Users, regardless of the Plan in use. To gain access to image generation in the AI Assistant, the User must purchase a paid Plan.

The "Vibe Block" feature includes daily Requests limits that are included in the Plan. The User has the right to purchase an additional number of Requests in the Personal Account, in the "Plans and Billing" tab.

The current cost of additional Requests is provided by the Administration in the Personal Account on the Platform. The specified cost includes applicable taxes and charges. Payment is made in order and in accordance with the instructions displayed in the Platform interface. If the User anticipates potential VAT liability on payments made by them, the Administration recommends that they seek advice from a tax consultant or accountant to independently account for VAT in the User's VAT return under the reverse charge scheme at the applicable VAT rate in the User's jurisdiction.

For certain Third‑Party Services, an increased coefficient for Request consumption is applied. The User can find detailed information about limits and coefficients, Request resets upon changing the Plan, and the refund procedure in the Personal Account and/or the Help Center.

1.4. Provision of the Function and Purposes of Use. The Function is provided by the Administration in beta "as is." The Administration does not guarantee error-free and continuous operation of the Function, as well as its compliance with the User expectations.

The User may use the Function solely to fill the Websites on the Platform with the Generated content. Using the Function for any other purposes is not allowed. The Function is not intended for obtaining information, consulting services, or expert opinion by the User, as well as for imitating creative activity.

1.4. Age Restrictions. The use of the Function by a minor is allowed exclusively with the consent of a parent or legal guardian with these Terms. The Administration does not guarantee the absence of information that does not correspond with the age category of a minor in the Generated content.
2. User Requests
2.1. General Restrictions and Limitations. While using the Function, it is not allowed to submit Requests deliberately aimed at creating the Generated content that conflicts with theAgreement's terms and conditions, general principles of good faith, morality, and ethics, principles, and norms of the applicable legislation.

The User shall not use the Function to create images of real-life people, places, and/or events that may be perceived as authentic and mislead third parties.

2.2. Privacy, Protection of Third Parties' Rights. The User is not allowed to submit a Request that contains text information that:
1) is the intellectual property of third parties and no appropriate permissions/licenses have been obtained;
2) violates the rights to privacy or contains the data that is a legally protected secret or other confidential information.

2.3. Personal Data. The User may not include their personal data or the personal data of third parties in the text of a Request, as well as submit Requests that suggest the creation of the Generated content that may include personal data.

2.4. Technical Limitations. The User agrees that the Function is based on the Third-party services and the Administration may have a limited influence on the Generated content according to the technical capabilities of the Third-party services.

However, the Administration strives for constant improvement of the Function, and therefore, the submission of specific Requests, as well as the creation of the Generated content that falls within specific categories/themes, may be limited.

The User is not allowed to carry out any attempts to bypass the technical limitations specified by the Administration or the Third-party services.
3. Generated Content
3.1. The Absence of Warranties and Assurances from the Administration. The Function is powered by artificial intelligence technologies provided by the Third-party services, therefore, the Administration has no technical possibility to fully control what the Generated content includes.

Among other things, the Administration is not able to identify the source of information that the Generated content is based on.

The Administration does not guarantee that the Generated content:
1) is relevant, correct, and acceptable, in the case of generating program code in the "Vibe Block" feature also technically functional;
2) complies with the generally accepted rules of behavior, as well as moral and ethical norms;
3) is unique and not based on information that is the intellectual property of the third parties;
4) does not violate the applicable legislation and/or the right of third parties.

3.2. The User's Responsibility for Determining Acceptability. The User is independently responsible for checking the Generated content for compliance with the applicable legislation, and the Agreement, as well as for compliance with the rights of third parties.

In case the Generated content is incorrect, unacceptable, or violates the legislation, and/or the rights of third parties, the User may report this to the Administration by clicking the "Complain about the result" button or using the feedback form in the Personal Account..
4. Intellectual property
4.1. Rights to the Function. The Function is a part of the Platform. All exclusive rights to the Function (including computer programs and design layouts, except for elements of Third-party services) belong to the right holder of the Platform.

4.2. Rights to the Generated Content. Under no circumstances the Generated content can be considered the result of the User's creative work and/or the intellectual property object, the rights to which belong to the User.

The User is aware that the Generated content is created with the use of artificial intelligence technologies, therefore the Generated content may not be unique and may be identical, completely or partially, to the Generated content created by the Requests of other Users.ms, the User is obliged to indemnify the Administration for all the damages incurred.
5. Liability And Indemnification of Damages
5.1. Limitation of Liability of the Administration. The information in the Generated content is for informational purposes and in no circumstances can be considered an opinion of the Administration, as well as perceived as advice, a recommendation, or an encouragement to carry out any action.

In any case, the Administration is not responsible for the information included in the Generated content and the result of its use by the User.

5.2. User's Responsibility and Indemnification of Damages. The User is completely responsible for the Requests' contents, as well as for the publication, distribution, storage, and transfer of the Generated content, and accepts all risks associated with the use of the Function, including those associated with the possible violation of the legislation and/or the rights of third parties.

The User agrees to indemnify the Administration and its affiliates, officers, directors, employees, and agents against any claims, disputes, demands, liabilities, damages, losses, and costs directly or indirectly associated with the User's use of the Function.

In the case that the Administration is subject to judicial and/or administrative proceedings, legal action, or a claim from any other third party due to the User's violation of these Terms, the User is obliged to indemnify the Administration for all the damages incurred.
