Agreement on the Terms of Use of Fonts

This Agreement (hereinafter — the "Agreement") governs the terms and conditions under which the Administration of the Tilda Publishing Platform (https://tilda.cc) (hereinafter — the "Administration", "Platform Administration") provides access to fonts (hereinafter — the "Fonts") to its customers (hereinafter — the "User", the "Platform User"), and is an integral part of the Platform's Terms of Service Agreement (https://tilda.cc/terms/).

With this Agreement, the Administration shall provide the Platform User with an opportunity to select for further use the Fonts available on https://tilda.cc, for further use in the User's personal account in the "Fonts and Colors" tab of the "Site Settings" section, for the purpose of creating their own Website (hereinafter, the “Website” will refer to a website created on the Tilda Publishing Platform with the tools provided by the Platform).

1. General Provisions

By using the Fonts, the Platform User accepts and agrees to all of the provisions of this Agreement (acceptance) without any reservations or conditions.

2. Fonts from Google Fonts

Google Fonts is a font library provided by Google. The Administration provides computing power to use the fonts directly through the Platform's tools. The Google Fonts Terms of Use can be found at https://fonts.google.com.

3. Fonts from Paratype

Paratype (https://www.paratype.com/) is a typeface manufacturer font. The Platform Administration grants Platform Users the ability to use certain Paratype fonts under a partnership agreement with Paratype. The Paratype fonts Terms of Use can be found at https://www.paratype.com/eula.

As of February 15, 2024, Paratype fonts are only available for use on the Platform on the Websites to which they were previously connected. If a font from the Paratype collection is disconnected, the font will become unavailable. In this case, the User may reconnect the font by purchasing the right to use it directly from Paratype or replace it with any other font, such as a basic font, a font from Google Fonts or Adobe Fonts libraries, or upload a custom font.

4. Fonts from type.today

Type.today (https://type.today) is a typefacefont manufacturer. The Platform Administration grants Platform Users the ability to use certain type.today fonts under a partnership agreement with type.today. The type.today fonts Terms of Use can be found at https://type.today/en/license/today.

If the Website is exported from the Platform and/or the subscription is not renewed, the font from the type.today collection used on the Website is disabled. In this case, the User needs to reconnect the font by purchasing the right to use it directly from type.today or replace it with any system font or font from the Google Fonts library.

5. Fonts from Adobe Fonts

Adobe Fonts is a service located at https://fonts.adobe.com, that provides web fonts for rent. Acquisition of any rights to fonts is at the User's own discretion. The Adobe Fonts Terms of Use can be found here.

6. Custom Font

The User has the right to independently upload the font they purchased in their personal account on the Platform. In this case, the User guarantees and is responsible for the legality of the use of the font that they upload, as well as the availability of all necessary authorization documents and/or appropriate rights to the font. If the right holder of the font requests to stop the unlawful use of the font by the User, the Platform Administration has the right, at its sole discretion, to block the project and/or the User's Account, or to limit the publishing rights of the project and/or User Account.

7. Granting Rights

The Administration shall provide tools for use of the Fonts to Users of the Platform. Any such use shall not contradict the terms and conditions of the license for the corresponding Font used by the User. The right granted to the Platform User is limited to the "right of use," and nothing in this Agreement shall constitute an assignment of the exclusive right to the Fonts to the User. The term of the right to use the Font is governed by the right holder of the Font or their authorized representatives (designees).

The Platform User acknowledges and agrees that all proprietary and/or non-proprietary copyrights to the Fonts belong to the Authors of such Fonts and are not transferred (not relinquished) to the Platform User under this Agreement. The Platform User undertakes not to perform any actions that violate or may violate the rights of the Authors or rights holders to the respective Fonts.

The Platform User is not vested with any copyright and/or intellectual property rights to the Fonts.

8. Permitted Use

The Platform User may use the Fonts solely for the creation of their Website on the Platform.

9. Prohibited Use

By using the Fonts, the Platform User agrees to the prohibitions and restrictions on their use set forth in the terms and conditions of the respective Fonts licenses and the terms and conditions of this Agreement, including, but not limited to, the following:

Prohibition on transferring, reselling, leasing, or otherwise transferring the Fonts to third parties;
prohibition on using the Fonts to create an official logo, brand name, trademark, or other intellectual property objects;
prohibition on placing the Font for free download on a shared disk, software, website, or any other device and/or resource for exchange, transfer, or distribution;
prohibition on downloading the source code or the file containing the Font source code from the Platform;
prohibition on the use of the Font in any manner not expressly provided for in the Font license and/or the terms and conditions of this Agreement.

Use of Fonts falling under the conditions of prohibited use shall be deemed copyright infringement. The Platform User shall be responsible for all losses resulting from copyright infringement, including any third-party claims. The Platform Administration reserves the right to restrict or prohibit the use of the Font if it has been used in violation of copyright.

10. Warranties and Responsibilities

The Platform's User represents and warrants that they will strictly abide by all of the Font license terms as stipulated in the respective Font licenses and in this Agreement and that they will bear sole responsibility for use of the Font in violation of the terms of use.

Fonts are provided on an "as is" basis with no warranties of any kind. The User assumes all risks associated with the quality of the Font and its use.

The Platform's Administration does not guarantee that the Fonts will be permanently available and is not responsible for their removal by the rightsholder or its authorized representatives (designees). The Rightsholder or its authorized representatives (designees) shall manage the Font collection at their own discretion and, therefore, may add or remove any Fonts at any time. The Administration of the Platform shall not be responsible for any costs, damages, and losses incurred by the User of the Platform as a result of such actions of the Rights Holder or its authorized representatives (designees) and in general as a result of the User's use of the Fonts.
